Atuação de Raquel Dodge frente à PGR ainda é uma incógnita

Escolhida nesta quarta-feira, 28, pelo presidente Michel Temer (PMDB) para substituir o atual procurador-geral da República, Rodrigo Janot, Raquel Dodge ainda é vista como uma incógnita no que diz respeito a sua atuação à frente do Ministério Público. É a primeira vez, desde 2003, que o presidente não escolhe o primeiro na lista tríplice da eleição interna da Associação Nacional dos Procuradores da república (ANPR) - Raquel estava em segundo lugar, atrás do subprocurador Nicolao Dino.

Se passar na sabatina do Senado, Raquel assume a Procuradoria-Geral da República por dois anos e será a primeira mulher a chegar ao cargo - a polêmica em torno do seu nome, porém, parece ter abafado esse fato. A subprocuradora não é alinhada a Janot, que trava um embate histórico com Temer e denunciou o presidente na última segunda-feira, 26.

Ao contrário do atual PGR, a escolhida de Temer mantém boas relações com o ministro Gilmar Mendes, do Supremo Tribunal Federal (STF), crítico recorrente dos métodos do Ministério Público Federal na Operação Lava Jato.

Com histórico em processos sensíveis, Raquel participou da Caixa de Pandora, operação que flagrou o então governador do Distrito Federal José Roberto Arruda pegando propina. Nessa investigação, como na Operação Patmos - desdobramento da delação da JBS -, áudios gravados por um investigado foram submetidos a um tenso debate sobre sua legalidade como prova.

Relembre algumas declarações de Raquel Dodge:

LAVA JATO

A subprocuradora Raquel Dodge afirmou, em entrevista ao jornal O Estado de S. Paulo, que, se eleita para a PGR, o enfrentamento à corrupção seria prioritário na sua gestão. "A corrupção ainda não cessou, mesmo após condenações e prisões. É preciso prosseguir neste trabalho até que o dinheiro público desviado seja integralmente devolvido aos cofres públicos, deixe de ser apropriado ilicitamente e passe a ser gasto em serviços públicos de qualidade, que atenda aos direitos fundamentais, garantidos na Constituição e nas leis."

Segundo Raquel, caso seja aprovada no Senado e ocupe a PGR, a equipe que cuida das investigações da Lava Jato será convidada a permanecer. Ela afirma, ainda, que a ampliará já que "novos fatos foram revelados e necessitam de uma atuação célere, para alcançar os resultados previstos na lei penal".

Em seu site, afirmou que os atuais membros da força-tarefa da Lava Jato em Curitiba, Porto Alegre, Rio de Janeiro, São Paulo e Brasília e outras forças tarefas serão "encorajados a permanecer, uma vez que a composição de cada força-tarefa é escolhida pelo promotor natural, titular do ofício e assim deve continuar."

INVESTIGAÇÃO DO PRESIDENTE

Raquel Dodge afirmou que a abertura de investigação diante de indícios de crime é "obrigação do titular da ação penal" que deve solicitar a avaliação da necessidade da investigação do Supremo Tribunal Federal.

Segundo a subprocuradora, até em casos de crimes praticados antes do mandato é possível realizar a investigação, mas sem apresentar a denúncia. "Me refiro à possibilidade com os argumentos de que ninguém está acima da lei e, também, para preservar os vestígios e as provas. Mas isso deve ser feito com cautela para não manchar o mandato do presidente da República", afirmou.

Com esse posicionamento, a escolhida por Michel Temer para ocupar o cargo de Janot seria a favor de que ele fosse investigado pelos crimes pelos quais foi acusado.

DELAÇÃO PREMIADA

A subprocuradora defendeu a imunidade para os delatores - desde que proporcional ao alcance da colaboração. Raquel afirmou que a legislação penal exige a reparação integral do dano e a devolução total das verbas públicas desviadas. Sem citar o polêmico acordo de delação premiada envolvendo os executivos da J&F;, a escolhida pelo presidente disse que a lei "admite que a sanção penal seja reduzida ou mesmo perdoada, de modo proporcional à colaboração efetivamente feita". Lembrou, ainda, que os acordos celebrados são submetidos ao crivo do Poder Judiciário e "podem ser rescindidos quando alguma cláusula for descumprida".

GESTÃO JANOT

Embora já tenha feito críticas a gestão Janot, Raquel afirmou que a devolução das verbas públicas apropriadas ilicitamente, o desmantelamento dos esquemas de corrupção e a condenação penal são importantes objetivos em curso da atual PGR.

FORÇAS-TAREFAS

Em abril deste ano, Raquel e Janot, tiveram um embate sobre proposta apresentada por ela ao Conselho Superior do Ministério Público Federal (CSMPF). Sua resolução limitaria o recrutamento de procuradores de outras unidades - estaduais, por exemplo - para forças-tarefas e cargos da Procuradoria-Geral da República (PGR).

Segundo Dodge, a regra de estabelecer que nenhuma unidade pudesse ceder mais do que 10% do seu quadro total de procuradores tem como objetivo não sobrecarregar as procuradorias. Isso, para a subprocuradora, poderia trazer fortalecimento de outras unidades do Ministério Público Federal e não traria impacto negativo na Lava Jato.

Já Janot afirmou que isso, sim, afetaria negativamente o grupo de trabalho Lava Jato na PGR e outros grupos de trabalhos criados com integrantes de outras procuradorias. O recrutamento de procuradores de outras unidades é um recurso amplamente utilizado para compor grupos de trabalhos relacionados a operações. Só no grupo de trabalho da Lava Jato na PGR, por exemplo, há nove procuradores cedidos por outras unidades.

GILMAR MENDES

No dia em que o ministro do STF Gilmar Mendes criticou a atuação do Ministério Público e afirmou haver "abusos" de juízes e procuradores em investigações, Raquel ouviu provocação do subprocurador Eitel Santiago, que disse que Raquel teria o apoio do ministro.

"Não procurei o ministro (da Justiça) Torquato (Jardim) ou Gilmar Mendes para que apoiassem o meu nome. Tenho me dirigido apenas internamente à classe. Mas caso entre na lista, farei contatos, como com o ministro da Justiça", respondeu Raquel.

10 MEDIDAS DE COMBATE À CORRUPÇÃO

Para a subprocuradora, as 10 medidas de Combate à Corrupção contribuíram para o aprimoramento das leis. "Dentre elas, destaco como muito positivas as que tipificam o enriquecimento ilícito, visam recuperar o lucro derivado do crime, garantir eficiência aos recursos no processo penal, a responsabilização de partidos políticos e do caixa dois, e a reforma do sistema de prescrição penal", disse.

DIREITOS HUMANOS

A defesa de direitos humanos e do meio ambiente vão ser reforçadas, segundo a subprocuradora. "Precisamos trabalhar para ter serviços públicos de qualidade, prestados de modo mais eficiente, sobretudo na área da infraestrutura e energia, para reduzir o custo Brasil e assegurar direitos básicos a custo menor", disse, em entrevista ao Estado. "Práticas iníquas como a escravidão contemporânea, o tráfico de pessoas e os crimes ambientais devem ser enfrentadas com rigor."

Raquel também enfatizou que a desigualdade social tem como causas a corrupção e a má gestão administrativa, que "entrega serviços públicos de má qualidade a custos elevados e inaceitáveis".

CONSELHO SUPERIOR DO MPF

A subprocuradora propõe, caso seja eleita para a PGR, a adoção de sistemas de sessões e pautas específicas no Conselho Superior do MPF, além da criação de comissões especializadas de assessoramento do conselho. Em seu site, explicou que pretende convocar audiências públicas, "para esclarecimento de fatos e posições em matéria administrativa, disciplinar e sobre a atividade-fim, e como mecanismo de consulta direta aos membros do MPF". Também está entre suas propostas dotar cada membro do Conselho Superior de um assessor.

O encontro, na noite de terça-feira (27), não constava na agenda oficial do presidente. Segundo o Palácio do Planalto, o grupo tratou sobre a reforma política. Porém, segundo O Estado de S. Paulo e o G1, eles discutiram, na realidade, a indicação de Raquel para chefiar o Ministério Público Federal (MPF).

Oito subprocuradores-gerais da República se candidataram à vaga. Os três mais votados pelos membros da ANPR formarão uma lista tríplice, que será então encaminhada à Presidência da República. Mais de 1,2 mil procuradores, entre ativos e aposentados, estão aptos a votar.

De acordo com a Constituição, o presidente da República pode escolher qualquer um dos mais de 1,4 mil procuradores da República em atividade para o comando da PGR. Desde 2003, no entanto, o nomeado é o mais votado pelos membros da ANPR.
