Public Ministry of São Paulo asks Lula prison in case of triplex

The Public Ministry of São Paulo filed the request for provisional arrest of former President Lula with the complaint on Wednesday (9), according to the Folha de S.Paulo newspaper. Prosecutors Cassio Conserino, José Carlos Blat and Fernando Henrique Araujo denounced the PT in the case involving the triplex in Guaruja (coast of São Paulo), which would be the family of the politician.

In addition to Lula, the application extends the former president of the OAS, Leo Pinheiro and former treasurer of the party, João Vaccari Neto. Judge Maria Priscilla Ernandes Veiga Oliveira, the 4th Criminal Court State will examine requests, but does not have a deadline to decide on the case.

Still do not know why prosecutors want the arrest of the former president, as the application runs under secrecy of justice in SP.

Former President Lula is accused of money laundering and forgery, crimes that can yield 3 to 10 years imprisonment and 1-3 years respectively. His wife, Marisa Leticia, and one of the couple's children, Fabio Luis Lula da Silva, are also accused of money laundering.

Other side
The lawyer of former president Lula family, Cristiano Zanin Martins, told Folha that was not reported on requests for arrest and highlighted the fragility of the arguments put forward by the Public Ministry of the State of São Paulo.
"Collective given by prosecutors shows the fragility of the investigation and that request, which is based on testimonies from people who suspect that the property was being done to the former president," said the lawyer.

Martins argues that the application will be rejected by the court due to the fragility of research arguments. "It makes no sense to assign the property to an owner who never used and was the site twice before it is finished to see if would want to be with him," he says.
