The Federal Supreme Court (STF) must be completed by Thursday next week (17/03) the trial of embargoes presented by the president of the Chamber of Deputies, Eduardo Cunha (PMDB-RJ), the impeachment of the rite of President Dilma Rousseff.
Understand the case and what will be voted by the Supreme Court.
- Cunha authorized on December 3, 2015 the request to initiate impeachment proceedings of President Dilma Rousseff.
- On December 8, a special committee was elected in the House of Representatives, when he won the single-sheet formed by opposition parties and dissident of the governing coalition, including the PMDB deputies. The group was elected by 272 votes against 199 by secret ballot at a session marked by turmoil since parliamentary contrary to secret voting process and the launch of an alternative slate to run for commission clashed with supporters of a secret ballot and alternative plate.
- On the same day, the PCdoB has filed in the Supreme Court to question the constitutionality of Law 1,079 / 50, which regulates the standards process and trial of impeachment, but predates the Constitution of 1988. The party questioned the rite adopted by Cunha, which allowed the participation of spare plate.
- Minister of STF Luiz Edson Fachin suspended the processing of the request for impeachment until 16 December, when the plenary court would dismiss the party. On December 17, the Supreme Court's ruling annulled the ordinance adopted by Cunha in the impeachment process.
- The ministers voted against the participation of a single piece of sheet members, with names not listed by party leaders, and against the choice by secret ballot of the committee members. The plenum of the Supreme also decided that it will be up to the House to authorize the opening of the process, but the Senate is to decide on the initiation of impeachment. - If senators decide not to initiate the impeachment process, it will be filed. If the decision is to establish, only from that time is that the president will be temporarily removed from office for a maximum period of 180 days. The STF ministers also rejected the need for prior defense of Dilma.
- If the impeachment proceedings to be opened in the Senate, there will be three votes: receipt of the complaint, pronunciation and sentence. Only the latter would need a quorum of 2/3; the others require only a simple majority vote.
- Even before the publication of the judgment by the Supreme Court, the House of Representatives had appealed, on February 1, against the decision of the Supreme Court.
-The Judgment of the content in which the Supreme Court considers unconstitutional some aspects of the election process of the special committee of the Board was published on Tuesday (08/03) by the Journal of Justice. In it, there is a summary of the decisions of the ministers, the votes of each and debates on the subject in the previous two sessions.
- With the publication of the document, the House of Representatives restate their questions on Tuesday and requested a review of the Supreme Court decision that annulled the rite of impeachment. The Chamber claims that the ministers of the Supreme interpreted wrongly the internal rules of the parliamentary house. The opposition expects that the Supreme modify part of its decision and allow the special committee formed by deputies be elected by secret ballot, and also with the participation of single plates.
- Once the Supreme finalize the analysis of resources, Cunha should continue to Rousseff's impeachment in the House of Representatives, with the installation on the same day, the special commission that will examine the impeachment process will be open or not . The formation of the committee shall observe the rules imposed by the Supreme Court.
