STF the Minister determines that Cunha follow with impeachment of Temer

Marco Aurélio Mello decides that the mayor could not have filed suit against the vice president and determines committee to open to examine the application. Temer is also accused by the "tax pedaling."

Minister Marco Aurélio Mello, the Supreme Court (STF) ruled on Tuesday (05/04) that the president of the Chamber of Deputies, Eduardo Cunha, accept the request for impeachment against the vice-president, Michel Temer and install a special committee to examine the matter.

The decision of Marcus Aurelius serves partly to a request from lawyer Mariel MARLEY Marra, who challenged the wedge decision to file the request for impeachment against Temer.

Marra had filed a request for opening of impeachment against Temer in the House in December, arguing that the vice president committed a crime committed with so-called "tax pedaling" when he signed decrees as interim president. This is the same irregularities which led to the impeachment of Rousseff. In addition, the PMDB would be, as the PT, involved the bribery scheme investigated by Operation Lava jet.

The minister rejected, however, a part of the application for Marra, in which the lawyer requested that Dilma's offside review process, already underway in the House, was suspended until there was a decision on the impeachment of Temer in the house .

Cunha will appeal the decision

The mayor said he will "appeal to all forms" to the decision of Marcus Aurelius, but will ask the party leaders to indicate the names of the members who will compose the committee. "We think the absurd decision, teratological and we will appeal, not only aggravating, probably entering a writ of mandamus with complaint in itself ADPF [fundamental precept of non-compliance action], whose trial has not been completed," said Cunha, after meeting with leaders.

For Cunha, the minister's decision contradicts other made by the magistrate himself and "invades" powers of the House. "This decision breaks the Chamber skills and, more than that, of the 39 [requests for impeachment] rejected, 19 were formal requirement and 20 they had content.
