Teenagers Sue Obama: Government and the fossil fuel industry requested the archiving of the case
The u.s. Government is being sued for the first time, who's not even born yet.
Who signs the process on behalf of the "future generations", is also not here for a long time: are 21 children and adolescents from 8 to 19 years who recorded an actionagainst Barack Obama, President of the United States, and other important political figures to be injuring their right to life, liberty and property.
That's because they believe that Governments are not doing enough to save the planet from global warming.
You know that the major consequences haven't arrived yet, and in some time, the problem will be left for them.
One of the Group's arguments that the authorities know the potential damage of fossil fuels for decades.
There are American studies about their harmful effects since 1979-much older thanthe children accusing the Government now.
It was known that reduce the emission of these gases was necessary to give reasonable conditions of life to future generations-and why they accuse the State of being in breach of their constitutional rights.
The Government and the fossil fuel industry requested the archiving of the case.
Judge Thomas Coffin, in the State of Oregon, assessed if future generations had theright to enter with this type of process-and agreed with the kids that way, since theywill be much more affected by the climatic imbalance.
The Government argued that it could not be directly held responsible for the use which is made of natural resources throughout the u.s. territory.
But there is, in the country, the doctrine of "public trust": according to this concept, the natural resources of all, and the Government acts as a "third-party administrator" of the population.
Judge Coffin decided then, that if these resources are poorly managed. In other words, the Government is failing.
With the favorable ruling in Oregon, children will have a chance to take the case to a court. But of course they are not alone in this.
The NGO Our Children's Trust is behind the process, providing lawyers for the group.
In addition, the only adult who signs the process is James Hansen, one of the most famous scientists by pressing global authorities openly by larger and more urgent actions to contain global warming.
If the kids win the process, the Government can legally be forced to adopt more aggressive policies to reduce the use of fossil fuels and the emission of greenhouse gases. This is not necessarily bad for Obama-the American Presidency in 2015 the clean energy Plan, which never left the role for opposition of Congress and the Supreme Court. A little push could help take the project from limbo.
The process of teenagers caught the attention of the United Nations, who asked one of the subscribers, Victoria Barrett, of 16 years, on earth day, April 22.
Her participation was part of the event in which 175 countries signed the Paris agreement, undertaking to keep world temperatures rise more than 2° C until the end of the century.
Still lacking ratification (when the commitment is formally assumed the Presidents) from at least 55 countries.
Even if it all works out and objectives are all completed, scientists still have doubts ifthe emission reduction will be enough to hold the increase in temperature.
Some believe the damage of global warming are already irreversible. Not really worth playing to the high international efforts-or else everything may worsen more and much faster.
