The Spanish Justice called on Tuesday (29) the Catalan President Artur Mas for organizing a symbolic consultation on independence on November 9, 2014, banned by the Constitutional Court.
But accused of disobedience, prevarication, embezzlement and usurpation of functions, must appear for questioning on 15 October. The decision was announced two days after regional elections gave an absolute majority to separatist parties in the Parliament of Catalonia.
"Continuing with this instruction wakes the practice of the statements of the accused (...): on 15 October 2015," said the coroner's note.
Prosecutors opened action in December against the regional president and two members of the Executive old organization of symbolic consultation, without legal value, which was attended by 2.3 million Catalans. Nearly 1.9 million voted for the independence of the 7.5 million inhabitants of the region.
The Catalan government, which since 2012 called for the organization of a self-determination referendum, request denied by the Spanish Prime Minister Government of Mariano Rajoy, he encouraged the celebration of the elections, despite the Constitutional Court banned it on a precautionary basis to examine whether it was within legality.
In June, the court announced the illegality of the vote as "an autonomous community can not call or perform actions that auspiciem the calling of a referendum, even if no referendum, which exceed the scope of its own powers," among which is not the territorial integrity of the country.
Prevented from organizing a legal referendum, but anticipated the regional elections last Sunday to turn them into a kind of plebiscite of its plan to separate Spain from the rest of Catalonia in 2017.
The parties favoring independence have failed the most votes, but won an absolute majority in the regional chamber (72 of 135 seats), a situation which, they say, legitimizes the process of separation of Catalonia.
