Facebook loses first battle on data storage

Facebook lost the first round of a court battle against some of its members who sued the company, accusing it of collecting and storing "illegally" biometric user data obtained from their faces in photographs.

The judge overseeing the case in federal court in California, United States, refused on Thursday a motion of Facebook asking the rejection of the case.

Facebook filed a motion arguing that users can not enter a complaint based on Illinois law on privacy of biometric information (BIPA in English siglaem), as agreed under the user that the California law would regulate their disputes with the company, and that the Illinois legislation on biometric information does not apply to "dial suggestions."

The court said the Illinois law is applicable and that the plaintiffs have filed a complaint under the protection of BIPA.

Users claimed that the facial recognition feature of Facebook that suggests markings photos collection and illegally store biometric data in violation of BIPA Illinois.

The case comes from some residents of Illinois under Illinois law, but the parties concordaramem transfer the case to the California court, court document showed.


Facebook was also the target of a lawsuit over its plan to issue new shares last month.
